Welcome to ShopersKlub. These Terms & Conditions ("Terms") govern your access to and use of the websiteshopersklub.com (the "Site"), our mobile application, and all transactions, purchases, and services provided by SHOPERSKLUB LLC ("we", "us", or "our").

Please read these Terms carefully. By accessing our Site, creating an account, browsing our catalog, or making a purchase, you agree to be bound by these Terms and all policies incorporated by reference. If you do not agree to all of these Terms, do not use this Site or purchase our products.

1. Eligibility & Account Security

By using this Site, you represent that you are at least 18 years old or the age of majority in your state or province of residence. If you are under the age of majority, you may only use this Site under the supervision of a parent or legal guardian.

To access certain features of the Site, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the confidentiality of your account password and security credentials.
  • Promptly update your account details to keep them accurate and complete.
  • Accept sole responsibility for all activities that occur under your account.

We reserve the right to refuse service, terminate accounts, or remove/edit content at our sole discretion if we suspect fraudulent activity, security breaches, or violations of these Terms.

2. Product Accuracy & Pricing

We make every reasonable effort to display the colors, specifications, and descriptions of our products, including footwear and apparel, as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the exact textures, colors, or details of the physical goods.

Pricing Errors: In the event that a product is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for that product, even if the order has been confirmed and your credit card charged. If your payment has already been processed and we cancel the order, we will promptly issue a full refund to the original payment method.

Inventory & Availability: Product availability is subject to change without notice. We reserve the right to limit the quantities of any products we offer or restrict sales to specific geographic regions or jurisdictions.

3. Order Acceptance, Billing & Payment

The receipt of an order confirmation email does not constitute our acceptance of an order or a formal offer to sell. We reserve the right, at our sole discretion, to refuse, modify, or cancel any order for any reason, including:

  • Limitations on quantities available for purchase.
  • Inaccuracies or errors in product, inventory, or pricing information.
  • Issues identified by our credit card billing and fraud detection systems.

You represent and warrant that you have the legal right to use any credit card, debit card, or other payment method provided in connection with any transaction. You agree to pay all charges incurred by you or users of your account, including shipping fees and applicable local sales taxes, at the prices in effect when the charges are incurred.

4. Shipping, Risk of Loss & Customs Duties

All orders placed through the Site are subject to our Shipping Info guidelines. Delivery dates are estimates and are not guaranteed. We are not responsible for delivery delays caused by shipping carriers, severe weather conditions, customs bottlenecks, or force majeure events.

Passage of Title & Risk: All physical items purchased from ShopersKlub are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery of the merchandise to the carrier (e.g., UPS, FedEx, USPS).

International Shipping: For deliveries outside the United States, you are considered the importer of record and are solely responsible for paying any import duties, customs tariffs, VAT, or local taxes levied by the destination country.

5. Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all software, source code, text, displays, graphics, page layouts, design elements, images, and logos) are owned by SHOPERSKLUB LLC, its licensors, or other providers of such materials and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

You are granted a limited, revocable, non-exclusive, and non-transferable license to access the Site for your personal, non-commercial shopping use. You must not copy, reproduce, modify, distribute, republish, scrape, or extract any materials from our Site without our express prior written consent.

6. Prohibited Site Uses

You agree not to use the Site or its Services:

  • For any unlawful purpose or in violation of any local, state, federal, or international law.
  • To upload, transmit, or distribute viruses, malware, trojan horses, or other malicious software.
  • To harvest, scrape, or gather data using automated bots, spiders, scripts, or intelligent agents.
  • To bypass, disable, or interfere with security-related features of the Site or attempt to gain unauthorized access to our database servers.
  • To impersonate any person or entity, or falsely state your affiliation with SHOPERSKLUB LLC.

7. Disclaimer of Warranties

THE SITE, THE SERVICES, AND ALL PRODUCTS PURCHASED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, SHOPERSKLUB LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE IS ENTIRELY AT YOUR OWN RISK.

8. Limitation of Liability

IN NO EVENT SHALL SHOPERSKLUB LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OF OR INABILITY TO USE THE SITE; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS; OR (III) ANY PRODUCTS PURCHASED OR OBTAINED THROUGH THE SITE, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR CUMULATIVE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES OR PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO SHOPERSKLUB LLC FOR THE PRODUCT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless SHOPERSKLUB LLC, its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, and employees from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your infringement of any intellectual property rights of a third party.

10. Governing Law & Dispute Resolution

These Terms, and all disputes or claims arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without giving effect to any choice of law or conflict of law rules.

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, including purchases or site security, shall be resolved through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place inHarrisonville, Missouri.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You hereby waive the right to participate in class actions or class-wide arbitrations.

11. Severability & Entire Agreement

If any provision of these Terms is determined by a court or arbitrator of competent jurisdiction to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms, together with our Privacy Policy, Cookie Policy, and shipping/return guidelines, constitute the entire legal agreement between you and SHOPERSKLUB LLC regarding your use of the Services, superseding any prior agreements or representations.
